Additional requirements for filling Form-ITR-6 for AY 2019-20

For Companies other than companies claiming exemption under section 11, are required to file their Income Tax Return in Form ITR-6. For AY 2019-20, CBDT has sought additional information in form ITR-6, details of which is as following:

1. Schedule SH-1 Shareholding of Unlisted Company (other than a start-up for which Schedule SH-2 is to be filled up)

 If you are an unlisted company, please furnish the following details in respective columns of this Schedule:

  • The details of shareholding as on 31st March, 2019;
  • The details of share application money pending allotment as on 31st March, 2019; and
  • The details of shareholder who did not have a shareholding as on 31stMarch, 2019 but had a shareholding during the financial year 2018-19.

Please note that if you are a start-up which has filed declaration in Form-2 with DPIIT, aforesaid details should be filled up as per Schedule SH-2 and not in this Schedule, otherwise fill this Schedule.

Details for shareholders/ applicants to be provided in Schedule SH-1 is as below:

  1. Name of Shareholder/ applicant
  2. Residential status in India
  3. Type of share (Equity/ Preference/ Right/ Sweat Equity/ Bonus/ Others)
  4. PAN
  5. Date of allotment
  6. Number of shares held
  7. Face value per share
  8. Issue price per share/ Proposed issue price per share
  9. Amount received
  10. Date on which cease to be shareholder
  11. In case of transfer, PAN of the new shareholder

2. Schedule SH-2 Shareholding of Start-ups (which has filed declaration in Form-2 with DPIIT)

In case you are a start-up and you have filed declaration in Form-2 with the Department for Promotion of Industry and Internal Trade (DPIIT), for seeking exemption from the provisions of section 56(2)(viib) of the Income-tax Act, before filing of the return of income, please furnish the following details of shareholding of the company in the respective columns of this Schedule:

  • The details of shareholding as on 31st March, 2019;
  • The details of share application money pending allotment as on 31st March, 2019; and
  • The details of shareholder who did not have a shareholding as on 31stMarch, 2019 but had a shareholding during the financial year 2018-19.

Details for shareholders/ applicants to be provided in Schedule SH-1 is as below:

  2. Category of shareholder (Non resident/ Venture Capital Company/ Venture Capital Fund/ Specified Company/ Any other person)

3. Schedule AL-1 Assets and liabilities as at the end of the year (for unlisted company other than start-up for which Schedule AL-2 is required to be filled up)

 If you are an unlisted company, please furnish the details of assets and liabilities of the company in the respective items of this Schedule.

Please note that if you are a start-up which has filed declaration in Form-2 with DPIIT, aforesaid details should be filled up as per Schedule AL-2 and not in this Schedule, otherwise fill this Schedule.

Information required in Schedule AL-1 is as below:

A. Details of building or land appurtenant there to, or both, being a residential house

  • Address

  • Purpose for which used (Guest house/ Director Quarter/ Director Use/ Staff Quarters/ Own Office/ Renting/ Leasing/ Stock in trade)

  • Shares acquired during the year (Number of shares, Types of share, Cost of acquisition)
  • Shares transferred during the year (Number of shares, Types of share, Sale Consideration)
  • Closing balance (Number of shares, Types of share, Cost of acquisition)

D. Details of unlisted equity shares

  • Name of company
  • PAN
  • Opening Balance (Number of shares, Cost of acquisition)
  • Shares acquired during the year (Number of shares,Date of subscription, Face Value Per Share, Issue Price/ Purchase Price)
  • Shares transferred during the year (Number of shares, sale consideration)
  • Closing balance (Number of shares, Cost of acquisition)

E. Details of other securities

F. Details of capital contribution to other entity

G.Details of Loans & Advances to any other concern (if money lending is not assessee’s substantial business)

H. Details of motor vehicle, aircraft, yacht, or other mode of transport

I. Details of Jewellery, archaeological collections, drawings, paintings, sculptures, any work of art or bullion

4. Schedule AL-2 Assets and liabilities as at the end of the year (for start-up which has filed declaration in Form-2 with DPIIT only)

 In case you are a start-up and you have filed declaration in Form-2 with the Department for Promotion of Industry and Internal Trade (DPIIT), for seeking exemption from the provisions of section 56(2)(viib) of the Income-tax Act, before filing of the return of income, please furnish the details of assets and liabilities of the company in the respective items of this Schedule.

5. Schedule FA Details of Foreign Assets and Income from any source outside India

 If you are a resident in India, you are required to furnish details of any foreign asset etc. in this Schedule.  This Schedule need not be filled up if you are„not ordinarily resident‟ or a „non-resident‟.

In tables A1 to G, please furnish the details of foreign assets or accounts of the following nature, held at any time during the relevant accounting period:-

  • Table A1 – Foreign depository accounts
  • Table A2 – Foreign custodian accounts
  • Table A3 – Foreign equity and debt interest
  • Table A4 – Foreign cash value insurance contract or annuity contract
  • Table B – Financial interest in any entity outside India
  • Table C – Any immovable property outside India
  • Table D – Any other capital assets outside
  • Table E – Any other account located outside India in which you are a signing authority (which is not reported in tables A1 to D)
  • Table F – Trust created outside India in which you are a trustee, a beneficiary or settlor
  • Table G – Any other income derived from any foreign source (which is not reported in tables A1 to F)

In case you are a resident in India, the details of all foreign assets or accounts in respect of which you are a beneficial owner, a beneficiary or the legal owner, is required to be mandatorily disclosed in the Schedule FA.
